Здравствуйте, ситуация такая.
Есть двухкомнатная квартира в Спб, в 1991 приватизирована.
Все время в ней проживаем и прописаны; я , мать, бабушка до 2000г (умерла). Соответственно до сих пор поделена на три части.
Мать состояла в гражданском браке с моим отцом который после моего рождения ушёл от неё как я понял он не имеет права претендовать.
То есть никаких других родственников, сложных отношений и претензий на долю нет, никто не съезжал, жили ровно всё время в этой квартире мы трое.
После смерти бабушки (в 2000) мать не стала обращаться к нотариусу легкомысленно считая что само всё перейдёт.
Сейчас хочет выправить документы принять в наследство третью долю чтобы всё было в порядке по документам.
Как я понял это фактическое принятие.
Из документов доказывающих пользование квартирой (фактическое принятие) в течении 6 мес, есть: 6 чеков оплаты домашнего телефона,
и одна квитанция за К.У., так получилось за шестимесячный период после смерти оплатили только за один месяц из шести.
Вопрос можно ли в после такого долгого срока переоформить долю?
Какова процедура переоформления докуметов, по фактическому принятию?
Какие ещё документы потребуются?
Насколько надёжно с такими доказательствами (фактич, принятия) идти в суд, высока ли вероятность что могут не признать принятие доли?
Достаточно ли документов для доказательства фактического вступления?
Какова правовая ситуация здесь с точки зрения опытных юристов, общая картина, на сколько всё плохо?
